1. NEW
RCRA/HAZARDOUS WASTE FEES
The
Tennessee Department of Environment and Conservation
(TDEC) has amended its hazardous waste fee structure.
The department now charges base dollar amounts in
addition to the fee assessed on each pound of hazardous
waste. The amendments include:
- Permit
fees for transporters, storage, and disposal facility
(TSD) activities related to response to accidental
discharges requiring remedial investigations and
on-site treatment;
- A
TSD installation identification number application
fee;
- TSD
annual maintenance fees;
- A
hazardous waste tipping fee;
- Generator
fees;
- Special
report fees.
The
proposed rule was revised and sent to the attorney
general for final review before becoming effective
on October 8, 2002. See Register

2. PROPOSED
TITLE V PERMIT FEE CHANGES
TDEC
is proposing to amend construction and annual air
emission fees. The proposed rate for major sources
with "actual based" annual emission fees is $28 per
ton per year. The proposed rate for major sources
with "allowable based" annual emission fees is $17
per ton per year. The accounting year period is July
1, 2002, to June 30, 2003. These annual rates will
be supported by the division's annual workload analysis
that is approved by the Tennessee Air Pollution Control
Board. See the Tennessee

3. NESHAP
FOR SURFACE COATING OF PLASTIC PARTS AND PRODUCTS
The
U.S. Environmental Protection Agency (EPA) is proposing
national emission standards for hazardous air pollutants
(NESHAP) for plastic parts and products surface coating
operations. The proposed rule applies to plastic
parts and products surface coating facilities that
are a major source, or are located at a major source,
of hazardous air pollutants. The source category
does not include research or laboratory facilities
or janitorial, building, and facility maintenance
operations; hobby shops that are operated for personal
rather than commercial purposes; or surface coating
of plastic parts and products that would be subject
to certain other subparts of 40 CFR part 63.
Late
in development of the proposed rule, Department of
Defense (DOD) stakeholders suggested that DOD operations
are distinctly different from the kinds of operations
addressed in these standards. They proposed that
a separate subcategory or source category dealing
with multiple surface coating operations performed
by DOD civilian and military personnel or performed
at DOD installations may be appropriate. EPA currently
is evaluating the need for a DOD source category
or subcategory and is requesting comment on the appropriate
approach for addressing unique DOD coating operations.

4. OSHA
REVISES EXIT ROUTES STANDARD
Requirements
for exiting buildings quickly during an emergency
have been rewritten in a user-friendly format that
is easier to understand, the Occupational Safety
and Health Administration (OSHA) announced. The revised
Exit Routes, Emergency Action Plans, and Fire Prevention
Plans Standard became effective on December 7, 2002.
"Having
a clear plan and procedure for exiting a building
as safely as possible, if necessary, is one of the
most basic and important safety precautions," said
OSHA Administrator John Henshaw. "OSHA's standard
was over 30 years old and in need of updating. The
changes to the language in this rule will make it
more clear and consistent and aid workers and employers
alike in understanding the requirements of the standard."
The
requirements for exit routes have been rewritten
in simple, straightforward, and easy-to-understand
terms. For example, "means of egress" will now be
referred to as "exit routes." The text has been reorganized,
and inconsistencies and duplicate requirements have
been removed. The revised rule has fewer subparagraphs
and a smaller number of cross-references to other
OSHA standards than the previous version.
Employers
now have the option of adopting the National Fire
Protection Associations' Life Safety Code instead
of the OSHA standard for exit routes. OSHA evaluated
the NFPA standard and concluded that it provides
comparable safety.
The
revised standard, which offers more compliance options
for employers, does not change the employer's regulatory
obligations for employee safety and health protection
of the original standard. The Exit Routes, Emergency
Action Plans, and Fire Prevention Plans standard

5. POTENTIAL
SPCC DEADLINE EXTENSION
The
U.S. Environmental Protection Agency (EPA) is working
on a proposed rule that would temporarily suspend
the February 17, 2003, deadline for facilities to
amend their Spill Prevention, Control, and Countermeasure
(SPCC) plans to conform with recent amendments to
the rules governing those plans, as well as the August
18, 2003, deadline for implementing such amendments.
The agency plans to propose the suspension (the duration
of which is still under consideration) in a direct-final
rule, with the possibility of one six-month extension
of that date if necessary. During the period of the
proposed temporary suspension, EPA plans to conduct
the fact-finding and other work necessary to propose
and finalize new compliance dates. Questions should

6. POLLUTION
PREVENTION HELP ON THE WEB
The
Pollution Prevention Resource Exchange (P2Rx), a
consortium of eight regional pollution prevention
information centers, makes available several helpful
resources available at its Web site: www.p2rx.org.
Among these resources are "topic
hubs" that give an overview, process information,
P2 options, and best documents (links) for specific
industrial sectors and topics.
Among
the topic hubs available are those on:

and food processing;
- Construction
industry;
- Facilities
design and management;
- Manufacturing
processes;
- Service
industries ;
- Transportation
New
topic hubs have recently been added on lithographic
printing (from member center Great Lakes Pollution
Prevention) and electronic waste (from Western Regional
Pollution Prevention Network).
If
